As was noted in our December 6 article, CMS issued a memorandum earlier this month stating it would suspend all activities related to implementing or enforcing the Mandate вЂњpending future developments in the litigation.вЂќ It is not clear at this time whether they will retract that memorandum given the latest developments, but such a reversal of course seems unlikely.
